For our Customers

transportation intermediary

Pate Logistics, LLC is a licensed transportation broker providing transportation services for its customers. We are not, nor will we hold ourselves out to be, a freight carrier. Simply put, we do not place hands on your freight; we are a means of finding the best possible shipping solution for your shipment, which we accomplish through negotiated rates, an extensive network of carriers and depth of experience in logistical operation. We are not agents of any shipper or freight carrier, and will at all times be considered an independent contractor.

CARRIER OPERATIONS AND EQUIPMENT

We don’t own trucks, trailers, or any other transportation related equipment. We cannot be held responsible for regular maintenance and/or upkeep and operation of our carriers’ equipment. Under no circumstances will any employee or representative of freight carriers be deemed employees or representatives of Pate Logistics. No freight carrier is authorized to act as a representative of Pate Logistics.

freight loss or claims

Pate Logistics’ sole obligation in regards to claims for loss or damage is to assist customers with the filing and processing of claims with the freight carrier arranged by Pate Logistics, if requested by the customer.

BILLS OF LADING

From time to time, whether it be for administrative convenience or oversight, Pate Logistics may be inaccurately named as the freight carrier on a bill of lading or other shipping document. However, this will not change the status of Pate Logistics as a transportation broker, nor does it obligate Pate Logistics to the liabilities of a freight carrier. Further, this does not rescind the responsibilities or liabilities of the dispatched carrier of the shipment in question.

Our promise to our customers

In good faith and in consideration of the trust you have placed with us as your transportation broker, we will exercise due diligence and caution in arranging carriers for each shipment. We will not engage with Carriers who have been issued Unsatisfactory safety ratings by the Federal Motor Carrier Safety Administration (“FMCSA”). We regularly review our carriers’ safety scores and inspection histories and keep record of any carriers who have been previously deemed to have unsatisfactory safety records or otherwise considered unfit to dispatch any of our customer’s freight.

Each carrier we work with has signed a broker/carrier agreement with Pate Logistics, which details our expectations for carrier performance and the terms and conditions of the relationship. A copy of this agreement is available upon request.

 

For our Carriers

hours of service

Legal hours of service are to be adhered to at all times. Pate Logistics has no control over loading/unloading times. If there is an hours of service issue that will prevent a timely pick up or delivery based on the schedule provided on the load confirmation, carriers are obligated to inform Pate Logistics immediately so that we can work together with all parties to reschedule.

In the event that a carrier receives documents with Pate Logistics listed as the carrier, it is the responsibility of the carrier to cross out Pate Logistics and write in their company name in its place.

freight claims and/or damages

Pate Logistics reserves the right to withhold or offset freight payment pending any open investigation regarding freight claims regarding loss or damage to property.

rate confirmations

For each shipment, Pate Logistics will provide carriers with an official rate confirmation. This rate confirmation will include shipper and consignee information, in addition to the agreed upon carrier rate including any accessorial charges.

In the event that other shipping documents are received by the carrier that state another shipper or consignee, it is the responsibility of the carrier to contact Pate Logistics immediately. The shipper and consignee detail that is listed on the rate confirmation provided by Pate Logistics will take precedence over any other shipping document received.

communication

For each shipment, Pate Logistics will provide expectations for regular communications, including how often status updates will be provided. It is the responsibility of the carrier to adhere to these communication expectations and provide Pate Logistics with regular updates regarding any delays and/or service issues, in addition to regular correspondence regarding pick up and delivery.

Depending on the type of shipment that is being moved, there may be some increased sensitivity to ongoing status reports. It is the responsibility of the carrier to be respectful of the shipper’s and consignee’s wishes and meet their guidelines for communication.
